We at DealSignal, Inc. (“DealSignal” or “We”) are committed to protecting your privacy.

This Privacy Policy applies to our Website (www.dealsignal.com), our Customer Information, and our Subscription Service (the “Service”), including our web and mobile applications, our database and our Application Programming Interfaces (“APIs”) owned and controlled by DealSignal. This Privacy Policy governs our data collection, processing and usage practices. It also describes your choices regarding use, access and correction of your personal information. If you do not agree with the data practices described in this Privacy Policy, you should not use the Website or the Service.

We periodically update this Privacy Policy. We will post any Privacy Policy changes on our website and, if the changes are significant, we will provide a more prominent notice by sending an email notification to users of our Service. While we will notify you of any material changes to this Privacy Policy, we encourage you to review this Privacy Policy periodically. We will also keep prior versions of this Privacy Policy in an archive for your review.

1. DealSignal Website

This Policy applies to the Website. It does not apply to any website of any third party, even if the third-party website links to (or is linked from) the Website. By accessing, using, and/or submitting information through the Website, you consent to the practices described in this Policy with regard to the information collected thereby as described herein. If you do not agree with this Policy, delete all cookies from your browser cache after visiting the Website and refrain from visiting or using the Website.

Website Visitor Information Collected

To browse the Website only, you are not required to provide any personal information. However, we may gather non-personally-identifiable information. Similar to many commercial websites, we utilize “cookies” and other technologies to collect non-personally-identifiable information on visitors to the Website. Cookies allow web servers to recognize the computer used to access a website. Cookies store information accessed through your browser to streamline activities on related web sites, and make the online experience easier and more personalized. In addition, when submitting information on the Website, your submission will be associated with the IP address you are then using, which is automatically assigned to your computer by your Internet Service Provider.

Use of Website Visitor Information

We use cookie data to measure site traffic and usage activity for purposes of improving and enhancing the functionality of the Website, to look for possible fraudulent activity, and to better understand the sources of traffic and transactions on the Website. Cookies also allow our servers to remember your account information for future visits and to provide personalized and streamlined information across related pages on the Website. You can choose to disable cookies for the Website but this may substantially limit your ability to use our Website. The use of cookies by our partners, affiliates, tracking utility company, or service providers is not covered by this Policy. We do not have access or control over these cookies.

Information collected from Website submissions will be used for DealSignal’s internal business purposes, including its research, sales, and marketing. We may use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering the Services. We may also derive your approximate location from your IP address.

We take reasonable steps to maintain the security of Website visitor information, do not license or sell such information to anyone, and will only share such information with a third party who has agreed to keep such information confidential and maintain the security thereof, and only for the purposes of facilitating one of the uses described herein on behalf of DealSignal.

We use Google Analytics, a web analytics service provided by Google, Inc., on our Website. Google Analytics uses cookies or other tracking technologies to help us analyze how users interact with and use the Website, compile reports on the Website’s activity, and provide other services related to Website activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a return visitor, and any referring website. The Website does not use Google Analytics to gather information that personally identifies you. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google’s privacy policies. 2. DealSignal Customer Information

Customer Information Collected

DealSignal may collect the following information from or regarding its customers: (1) personal contact information regarding users of the Services (“User Information”); (2) information uploaded to our system by a user of the Services (“Uploaded Information”); and (3) usage logs regarding the use of the Services, including logins and other actions taken, time stamps, IP address, and other usage data (“Usage Logs”) (collectively, “Customer Information”). In addition, in connection with purchasing the Services, we may receive credit card or other payment information (“Payment Information”).

You may be a user that has been provided access to the DealSignal site and database through your company license agreement. Your employer may require that one or more users have global rights to access any and all information of every user that has access through the company. If you have questions or concerns regarding the rights of other individuals in your company to access your User Information, Uploaded Information, or Usage Logs, you should raise those concerns with the appropriate person at your company.

Use of Customer Information

Customer Information may be used for DealSignal’s legitimate business interests in connection with your use of the Services, including to respond to user inquiries and fulfill user requests, complete transactions, provide customer service, send administrative information, and to personalize user experience with the Services. We may use Customer Information to better understand our users in general and to improve the content and functionality of the Services. We may use Customer Information to contact you in the future to tell you about services, promotions, opportunities, and other general information about DealSignal we believe will be of interest to you. We may use Customer Information to investigate and prosecute potential breaches of DealSignal’s security or license agreements.

We will not disclose Customer Information to any third party except in connection with a legitimate use as set forth herein, in connection with a bona fide legal dispute to which such information is relevant, in response to valid, compulsory legal process, or as otherwise required by law. DealSignal will, whenever possible, obtain confidentiality agreements from any person or entity to whom Customer Information is disclosed and ensure any recipients are committed to employing appropriate technological security measures.

We employ reasonable security and back-up procedures to protect Customer Information. However, in the unlikely event there is a loss or corruption of Customer Information, DealSignal is not responsible or liable for such loss or corruption. We encourage our users to retain copies of all Uploaded Information on their own system.

We will use Payment Information solely for the purpose of fulfilling purchase requests. We will store Payment Information in an encrypted form and will not sell, share, or use it again without prior consent.

Customer Use of DealSignal Integrations

As part of the Services, DealSignal may make available to its Customers certain Integrations. In using DealSignal Integrations, such as DealSignal’s Salesforce integration, Business Contact Information from Customer’s CRM may be transmitted to DealSignal for purposes of matching or cleansing Customer’s data against DealSignal’s database as a feature of the Services. In that event, We may retain and store such Business Information for purposes of identifying potential contacts to supplement the Services, verifying the accuracy of such Business Information, removing out-of-date Business Information from the Services, or otherwise improving DealSignal’s research processes and the content provided through the Services. Information so received will be completely anonymous as to the source. In the event that any customer wishes to opt out of DealSignal’s use of such information, they may contact us at support@dealsignal.com.

3. DealSignal Subscription Service

Our Subscription Service (the “Service”) consists of our web-based application, mobile application, database and Application Programming Interfaces (“APIs”) that provide Business Information about companies (“Company Profiles”) and their employees (“Contact Profiles”). The Service allows any Customer or User that uses it (our Customers, their Employees, and DealSignal itself) to view, share, import and export this Business Information. The Service can be used to run Jobs to collect publicly-available information, and/or organize and save Company and/or Contact Profiles into Lists. The resulting Company and/or Contact Profiles and Lists are made accessible through the Service. The Business Information is stored and managed securely on our service providers’ servers.

4. Information We Collect

Information collected and/or published in a Company Profile on the Service may Ie Business Information such as the name of the company, its location, ownership structure, website, social media sites and related posts, phone, email, key business metrics, news, and Contact Profiles of certain employees – information obtained from publicly-available sources and/or company information published by third parties.

Information collected and/or published in a Contact Profile on the Service may include Business Information – similar to that which is typically included on a business card, business email signature block, or an online professional profile – such as name, title, company, current position, prior positions, publications, articles by, about, or quoting an individual, links to public social media postings by or about the individual, professional contact information and similar information relating to the professional sphere of an individual.

Our Sources of Information

DealSignal compiles Business Information for its Service in four ways:

  • Our search technology scans the web and gathers publicly-available Business Information.
  • Our professional researchers search the web and gather publicly-available Business Information.
  • We license Information from other companies.
  • Users contribute Business Information about themselves or other people and companies.

To ensure the integrity of the Service, we take the following steps:

  • Business Information Only – DealSignal only provides business-related information. Therefore, any contacts that have an email address from a consumer-oriented service such as Gmail, Hotmail or Yahoo are disregarded.
  • Anonymity – We do not disclose who contributed particular Information using the DealSignal Research Platform or other contribution methods.
  • Opt-Out – Any person added to the Service may request to be removed at any time, via email at support@dealsignal.com. We promptly honor such requests.

5. Use of the Information We Collect

Use by DealSignal

We use our own Service to build lists that we use to research and contact potential customers, partners, service providers, investors, employees, or contractors. Information that we collect and manage using the Service for our own market analysis, sales and marketing belongs to us and is used, disclosed and protected according to this Privacy Policy.

Use by Our Customers

Our customers use the Service to build lists to research and contact potential customers, partners, service providers, investors, employees, or contractors. We do not control the process, content or the types of information that our customers may choose to use to contact companies or their employees. We process our customers’ information as they direct and in accordance with our agreements with our customers, and we store it securely on our service providers’ servers, but we do not have control over the collection or management of customer information. Our agreements with our customers prohibit us from using that information, except as necessary to provide and improve the Service, as permitted by this Privacy Policy, and as required by law.

DealSignal collects information under the direction of its customers, and it has no direct relationship with the companies and individuals whose Business Information it processes. If you are a customer of one of our customers and would no longer like to be contacted by one of our customers that use our Service, please contact the customer that you interact with directly.

“Sensitive Information”

Our agreements with our customers prohibit them from using the Service to collect, manage, or process Sensitive Information. We are not responsible for our customers’ use of information they collect on the Service.

This refers to credit or debit card numbers, personal financial account information, Social Security numbers, passport numbers, driver’s license numbers or similar personal identifiers, racial or ethnic origin, physical or mental health condition or information, or other employment, financial, political or health information.

6. Disclosure of Information about The Service

If we have included your business contact information in our Service, such information may be disclosed to DealSignal customers who have entered into license agreements with us. Such agreements require any such licensee to use such information only for such licensee’s internal business purposes, including sales, marketing or recruiting, and not to disclose such information to third parties. Such agreements prohibit such licensees from using any of the information in violation of any applicable law.

7. How to Make Add, Correct or Remove Business, Customer and User Information

Additions, Corrections – Profiles
Any individual has the right to obtain access to the Profile and any other information that DealSignal holds about him or her. If the individual determines that his or her Profile is incomplete or that factual information about him or her or the company is incorrect, he or she may propose an addition or correction. We will accept and implement the proposed addition or correction upon receiving adequate proof of the authenticity and accuracy of the supplied information and if the supplied information meets our selection criteria and internal policies regarding information collected for the creation of Profiles. To request access, addition or correction of your Profile information, please contact us at support@dealsignal.com. We will respond to your request within a reasonable time in accordance with our internal policies on access, addition, or correction to Profiles and sources of information.

Additions, Corrections – Individuals
DealSignal has no direct relationship with the individuals whose personal data it processes on behalf of its customers. Individuals seeking to access, correct or delete their data should direct their query to the relevant DealSignal customer (acting as data controller). DealSignal will pass requests on to the relevant data controller within a reasonable timeframe.

Additions, Corrections – Subscribers
Customers and/or Users may update or change their User Settings and/or Team Settings by editing their user or organization record.

Opting Out – Individuals
An individual has the right to request that DealSignal unpublish, remove, or make unavailable to third parties any information about him or her from the Service or disconnect a link to another site. We will respond promptly in accordance with our internal policies on access to Profiles.

To request that DealSignal unpublish your Profile or remove a link, please contact us at support@dealsignal.com. Please note that while access by general user information may be discontinued, DealSignal may retain and use some or all Profile information as necessary for the management of the Service (for example, to identify your name and profile as blocked from publication) or to comply with our legal obligations, resolve disputes and/or enforce our agreements. Please note DealSignal often collects information based on its customers’ instructions and has no control over how they use company and/or contact data. If individuals would like to opt out of communications from our customers that use the Service, please contact those entities directly.

Opting Out – Users
Users may opt-out of receiving promotional communications by following the unsubscribe instructions included in such emails or by contacting us at support@dealsignal.com. Users of our cost-free services agree to receive our promotional communications while continuing to use such Services at no cost. Cost-free Service users electing to unsubscribe from receiving our promotional communications may no longer be entitled to access the cost-free Service. Individual users designated as “administrators” may not opt out of receiving administrative notices that are not promotional in nature.

Companies
The authorized representative of a corporation or other business or entity (other than a natural person) may obtain access to the Company’s Profile and be informed about the source of the information used to create that Profile.

If an authorized Company representative determines that the Profile of the Company is incomplete or factual information about the Company is incorrect, he/she may propose an addition or correction or deletion. We will accept and implement the proposed addition or correction or deletion upon receiving adequate proof of the authority of the individual to request a correction or deletion on behalf of the Company and proof of the authenticity and accuracy of the supplied information and given the supplied information meets our selection criteria and internal policies regarding information collected for the creation of Profiles.

8. Miscellaneous Provisions

Privacy Shield
DealSignal complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. If there is any conflict between the policies in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. To learn more about the Privacy Shield program (including the Privacy Shield Principles), any rights you may have to binding arbitration before a Privacy Shield Panel please visit https://www.privacyshield.gov.

For information received under the Privacy Shield, DealSignal will require third parties to whom DealSignal discloses personal information to safeguard that personal information consistent with this Policy by contract, obligating those third parties to provide at least the same level of protection as is required by the Privacy Shield Principles. EU and Swiss citizens may choose to opt-out of such disclosures. In compliance with the Privacy Shield Principles, DealSignal commits to resolve complaints about your privacy and our collection or use of your personal information. European Union or Swiss individuals with inquiries or complaints regarding this Policy should first contact DealSignal at support@dealsignal.com. European Union and Swiss individuals have the right to access their personal data.

DealSignal further has committed to refer unresolved privacy complaints under the Privacy Shield Principles to JAMS (Judicial Arbitration & Mediation Services), an independent alternative dispute resolution provider located in the United States and recognized for this purpose by the US Department of Commerce. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://www.jamsadr.com/eu-us-privacy-shield for more information, and to file a complaint.

The Federal Trade Commission has enforcement authority regarding DealSignal’s compliance with the Privacy Shield Principles.

The General Data Protection Regulation (“GDPR”) 2016/679
DealSignal endeavors to comply with the provisions of the GDPR as to any information in its possession regarding European Union-based persons (“data subjects”). As such, DealSignal only processes personal information on data subjects where it has a lawful basis to do so, which may include the consent of the person (especially in the case of website visitors who provide their information), performance of a contract, compliance with a legal obligation, or a legitimate business interest of DealSignal, the controller or a third party. DealSignal provides notice to all data subjects as required by GDPR Article 13 or 14, as appropriate, and honors the rights of data subjects provided in Articles 12-23, including the right to be forgotten.

Security
We employ reasonable security controls to protect all of the information subject to this Policy.

Change in Control
In the event of a merger, acquisition, reorganization, bankruptcy, or other similar events, any information in our possession may be transferred to our successor or assignee.
